Deadline approaches for compliance with EU Regulation 2020/1683, restriction on hair and eyelash dye products

From June 3, 2022, hair and eyelash dye products containing 1,2,4-Trihydroxybenzene, 4-Amino-3-hydroxytoluene and 2-[(4-Amino-2-nitrophenyl)-amino]-benzoic acid must not be made available on EU market.

From June 3, 2022, hair and eyelash dye products containing 1,2,4-Trihydroxybenzene, 4-Amino-3-hydroxytoluene and 2-[(4-Amino-2-nitrophenyl)-amino]-benzoic acid must not be made available on EU market. 

Commission Regulation (EU) 2020/1683 of 12 November 2020 amending Annexes II and III to Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products introduced several changes relating to hair and eyelash dyes.
Among these amendments to the Cosmetic Regulation is a prohibition on the use of 1,2,4-Trihydroxybenzene, 4-Amino-3-hydroxytoluene and 2-[(4-Amino-2-nitrophenyl)-amino]-benzoic acid in hair and eyelash dye products.
This regulation became effective on December 2, 2020, the twentieth day following publication. The transition period for compliance with the new requirements, given in Commission Regulation (EU) 2020/1683, ends on June 3, 2022. From this date, all hair and eyelash dye products containing substances listed in the updated Annex II must not be made available on the EU market.

The responsible person must carefully consider the transitional timeline and withdraw products not in compliance with the new requirement before the transitional period elapses.
