China has recently introduced new regulations governing the public labels on agricultural products, aimed at strengthening the management of national special and high-quality new agricultural products' public labels. The regulations are designed to safeguard the legal rights and interests of the entities certified with the national special and high-quality new agricultural products, including certificate holders and recommended production and business entities. The regulations, outlined in the "National Special and High-Quality New Agricultural Products Public Label Usage Management Standards," provide a comprehensive framework for the use and oversight of these labels.

Key Provisions:

Enforceable on Jan 5, 2024
  1. Combination of Labels: The public labels for national special and high-quality new agricultural products will now combine the "China Agricultural Product Quality and Safety Public Label" with the phrase "National Special and High-Quality New Agricultural Products." This combination will be the standard marking approach for these products.

  2. Authorized Use: Entities certified with national special and high-quality new agricultural products are permitted to use the public labels on their certified products, including packaging, labels, and manuals. The label should also display the certificate number. Additionally, these entities can use the labels in advertising, exhibitions, and media promotion activities related to the certified products.

  3. Design and Printing Standards: The design and printing of the public labels must adhere to the requirements specified in the "National Special and High-Quality New Agricultural Products Public Label Design and Usage Standards Manual."

  4. Management and Record-keeping: Certified entities are required to strengthen label use management, establish usage management systems, and maintain records accurately documenting label usage. These records should be kept for a minimum of two years and are subject to supervision and inspection by agricultural product quality and safety organizations and the public.

  5. Restrictions on Usage: Certified entities must not exceed the approved scope for using the public labels. If the certified product uses national special and high-quality new agricultural products as the main ingredient, this must be explicitly stated on the packaging.

  6. Anti-counterfeiting Measures: Counterfeiting, forging, or impersonating the national special and high-quality new agricultural products' public labels is strictly prohibited, with legal consequences for violators.

  7. Supervision and Reporting: Local authorities above the county level are responsible for monitoring and inspecting the usage of public labels. Regular reports on the usage and supervision results must be submitted to higher-level agricultural authorities.

  8. Reporting Violations: Any individual or organization has the right to report or complain about violations of these regulations to the local agricultural and rural authorities above the county level.
